In spring 2022, the County of Brant reviewed Fence By-Law 54-03 to update its policies relating to fences located on private property throughout the County, and for the inclusion of enclosures around swimming pools. Fence By-Law 54-03 was originally approved in 2003. 

As a result, a new draft Fence By-Law and separate Swimming Pool Enclosure By-Law are being proposed to address implementation barriers. 

The revised Fence By-Law proposes:

  • changes to height regulations 
  • includes regulations relating to privacy screening. 

The new draft Swimming Pool Enclosure By-Law proposes:

  • to regulate enclosures surrounding privately owned swimming pools including above ground and hydro-massage pools, 
  • maintenance of enclosures to ensure community health and safety 
  • changes to the height regulations

If approved, these by-laws will apply to all properties within the County of Brant. The draft Fence and Swimming Pool Enclosure By-laws can be viewed here under documents.

Good afternoon Council,
A few thoughts:

3.4: Do we really need fences where someone has an above-ground pool with no ladder in it, or where the ladder has been covered with a board?
4.1: Why is there a maximum height for a fence? What is the risk for fences being greater than 2m high?
4.1.6: Wrought iron fences are sometimes used on sloped backyards. This causes an asymetrical gap below the fence. What is the limitation on the size of this bottom gap? I don't see any
3: Temporary Pools: inflatable etc holding in excess of 600mm of water: Are fences required for these pools? These pools have removable ladders, making the pool inaccessible. I don't see how removing a ladder is not a sufficient safety and security measure. I also disagree that these temporary pools should be subjected to permeting. Please provide evidence for why this is necessary and studies showing the direct benefits to the community at large... We are a county with significant rural land. Please don't lose context of our community.

Is there a possibility the County could provide a document that outlines the proposed changes without all the legalise of the by law wording - what are the proposed changes and what do they mean to the average homeowner who has a pool?
