In spring 2022, the County of Brant reviewed Fence By-Law 54-03 to update its policies relating to fences located on private property throughout the County, and for the inclusion of enclosures around swimming pools. Fence By-Law 54-03 was originally approved in 2003. 

As a result, a new draft Fence By-Law and separate Swimming Pool Enclosure By-Law are being proposed to address implementation barriers. 

The revised Fence By-Law proposes:

  • changes to height regulations 
  • includes regulations relating to privacy screening. 

The new draft Swimming Pool Enclosure By-Law proposes:

  • to regulate enclosures surrounding privately owned swimming pools including above ground and hydro-massage pools, 
  • maintenance of enclosures to ensure community health and safety 
  • changes to the height regulations

If approved, these by-laws will apply to all properties within the County of Brant. The draft Fence and Swimming Pool Enclosure By-laws can be viewed here under documents.

    Requirements relating to swimming pool equipment, such as pumps and heaters, are currently governed under the County of Brant Zoning By-Law 61-16As a note these requirements are not proposed to change through this project. 

    This project seeks to update the existing Fence By-Law 54-03 and create a new Swimming Pool By-Law which will focus on enclosures and safety of these structures, not location, setbacks, or equipment provisions.
