Public Notice: Community Planning Permit Bylaw Appealed

The County of Brant is advising the community that appeals have been filed regarding both the Official Plan Amendment (By-law 83-26) and Community Planning Permit (CPP) Bylaw (Bylaw 84-26), following Council's adoption of the CPPS on July 28, 2026, and the close of the appeal period on August 17, 2026, at 4:00pm.

As a result, the Official Plan Amendment and the CPP Bylaw will not come into effect on August 22, 2026.

Background

In September 2025, the County of Brant began work on a new Community Planning Permit System (CPPS), a tool that will make the development process clearer, faster, and easier to navigate.

Between September 2025 and March 2026, the County provided several opportunities to learn about the new proposed CPPS and share feedback. The feedback gathered through the survey and open houses helped the development of the County’s CPPS and the CPP Bylaw.

On July 28, 2026, County of Brant Council approved the Official Plan Amendment (Bylaw 83-26) and the Community Planning Permit By-law (Bylaw 84-26).

What’s Next

The existing Zoning By-law and Site Plan Control Bylaw will remain in effect while the appeals proceed through the Ontario Land Tribunal (OLT) process. Accordingly, all development applications will continue to be submitted and processed under the current planning framework.

Staff will continue to work with applicants to discuss and evaluate how the CPPS may impact them as more becomes known about the appeals. That said, the CPPS remains subject to the outcome of the appeal process, and the OLT will determine how the appeals will be addressed, including timelines, procedures, and any hearing information.

The County is currently reviewing the appeal materials to participate in the OLT proceedings. Please also note that although implementation of the CPPS has been delayed, the Committee of Adjustment has been dissolved, meaning Minor Variance and detailed Consent applications will be considered by Council. Basic consent applications have been delegated to staff.
